Content Creators...Liable?!

Influencers or content creators as they’re often called are social media personalities with followings in a particular age/ gender/ interest demographic who get paid to advertise products and services on their accounts. These influencers are not the actual sellers but they are representing the products and services to their audience to drive sales and they may be subject to liability.

If an influencer was less than truthful in their endorsement of a company and their content influenced a consumer the influencer could face liability for false advertising. 

Content creators should avoid making false statements about products, services and brands and especially avoid endorsing a product or brand they have not actually tried if their marketing campaign gives the impression that it is the influencer’s personal opinion based on their experience.
